darcshadow 1,627 Posted September 22, 2016 Trademarks are a big deal. If the company doesn't protect them, they can actually be lost. And in the case I 100% agree with HD. HD was the first thing that comes to mind when you see that logo from a distance.
Dakotagrafx 7,297 Posted September 22, 2016 the shield itself has held up in court before when harley pushed it so anything with that shield would be subject then to make it black and orange is just icing on the cake for Harley
Sue2 920 Posted September 22, 2016 Well, they're not using the same orange..and black is black... you can't copyright standard color combinations..... and the actual shield is a different shape. The letter shaping in the shield is the same, the font is different. The center text is definitely different...... I would say a close call if you just look at the artwork. BUT the intent is surely there. Just my take on it. Sue2
Dakotagrafx 7,297 Posted September 22, 2016 does looking at it make you think of the original? if I bet on the outcome - my bet is on HD
slice&dice 2,450 Posted September 22, 2016 Listen, it was just a bad idea to begin with, trying to "IMP" H-D in any way. And someone is going to get fired at Forever 21 for going along with this.
darcshadow 1,627 Posted September 22, 2016 If it was just copyright infringement, they might be able to get away with it, but it's trademark infringement which is taken quite a bit more serious.
Monkey 252 Posted September 23, 2016 They sue al the time and win. Not worth the trouble to make something like their logo
skener 11 Posted October 8, 2016 Wonder if they had not used a "Harley" in my opinion:) look a like badge if it would have made any difference to the sales figures for the jackets?
MadHatterGraphix 1,258 Posted October 10, 2016 to be honest I see the copyright image I think of knights and swords Harley is just a money hungry bunch of jerks as usual. And I live not that far from them.

Go-C Graphics 856 Posted October 10, 2016 In HD defense The forever 21 patch looks like crap.
3barefoot 52 Posted October 11, 2016 Did anyone watch the special they did on how Harley got started??? They got sued when they had just started making it. It was a good 3 night program. To me the shields are different shape, Different fonts, different styles, BUT yet all the same. I can see where Harley will win. I agree with GO-C Forever 21's looks like crap!! I wouldn't have bought the jacket in the first place.
Wildgoose 4,200 Posted October 11, 2016 That was an interesting series. Reading about how the series was made revealed that HD was not involved too much (supposedly) in the making but it was obviously pretty biased toward them making Indian out to be the bad guys. Good entertainment with some factual elements but a lot of conjecture.
