Trademark issues?

Hey... If this guy;  http://feedback.ebay.com/ws/eBayISAPI.dll?ViewFeedback2&userid=mudsharkgraphics&ftab=AllFeedback

doesn't have trademark deals with the company... doesnt he have to worry about some serious lawsuits?  Is there a way to get around this? 

It just strikes me as odd since he's  powerseller and all.  If he was going to get in trouble you think it would have happened by now!

If the seller is licensed to sell these products, one would think he would be boldly touting that fact to set him apart from the many others that aren't. If the seller is licensed to sell these products, one would think he would be selling variations to recoup his licensing costs.

Only the seller and the owners of the designs really know, I'd say it's unlikely he holds license to any of the commercial designs he is selling.

Thing is the longer one sells an item without license, the more secure they may feel about getting away with it. If someone at some time should feel a desire to recover losses to their design, damages could be based on sales numbers, do you think this seller is tucking away money to protect in that event?

Edge , That is my reasoning also . I sent him a question thru e-bay asking him if I would have any problems because of copyright if I bought his decal . I will post If & what is the response is . It doesn't bother me what anybody does . They take the chance .. just like gambling at a casino.. just have to weigh the risk vs benifit & live with the results .

Good to know... I just wondered if there were some type of designs that weren't 'trademarked' but I figured that all recognizable logos would be considered trademarked.  I.E. I know that the Iowa Hawkeyes are very touchy about their tigerhawk.  It was more of a 'for instance' than anything else.  I'd say if that dude want's to take the risk of a big lawsuit... More power too him?!?

On the same note... Where do you go to get this type of liscencing information? I imagine they are VERY expensive, but, alas I am new and uniformed.
